Senate Passes Paycheck Protection Flexibility Legislation, Goes to President for Signature

On Wednesday afternoon, June 3, 2020, the U.S. Senate passed legislation loosening restrictions for borrowers under the Paycheck Protection Program. H.R.7010 is headed to the White House as of press time where the President is expected to sign the bill into law.

The Paycheck Protection Program was established under the CARES Act, which passed at the end of March when it was anticipated that the COVID pandemic would have subsided. The economy is not expected to fully recover as states slowly begin to reopen in phases.

NYSDOH SYMPTOM-BASED STRATEGY TO DISCONTINUE HOME ISOLATION FOR PERSONS WITH COVID-19

The New York State Department of Health issued this advisory over the weekend which was not widely distributed. It does, however, revise the current standard for home isolation and will be important to all employers already opened or reopening under additional NY Forward Phased Re-opening.

Legislation in House and Senate Provides PPP Flexibility

Sen. Angus King (I-ME) and Sen. Steve Daines (R-MT) introduced legislation to improve the Paycheck Protection Program (PPP) for small businesses that have taken advantage of the SBA program to help keep their companies afloat and employees on the payroll in light of the COVID-19 pandemic.

The PPP program is a $650 billion loan program for small businesses that was established within a very short timeframe and under the assumption that the economic shutdown that resulted in the wake of the pandemic would have subsided by now. However, as the pandemic continues and state governors expect to return to normal activity in several phases as opposed to more expeditious strategies, policymakers see it as necessary to modify the terms of the program in order to mitigate any negative impact resulting from the inactivity of small businesses that have taken advantage of it.

COVID-19 Update NYS

Two More Regions to Open: Long Island and the Mid-Hudson regions look to be on track to open for phase one activity “sometime next week” according to Governor Cuomo; while not providing an exact date, he did say that he’s allowing construction staging to begin in both regions immediately in preparation for next week’s expected approval. Based on what we know, look at Wednesday, May 27 as a target date for Long Island; Mid-Hudson might be a slight bit later than that. Nothing is official; we just want to make sure you’re prepared.

House Democrats Release Phase 4 Proposal Worth $3 Trillion

On Tuesday, May 12, 2020, Democratic leadership in the U.S. House of Representatives introduced “Phase 4” legislation in response to the COVID-19 pandemic.

H.R.6800, the Health and Economic Recovery Omnibus Emergency Solutions (HEROES) Act, is a $3 trillion comprehensive spending package. The proposal includes $1 trillion in emergency relief for states to combat the outbreak, $200 billion in assistance for essential workers, and an additional round of relief payments to qualified individuals and couples.

We have explained to employees that work is optional during this time and we have encouraged employees to stay home if they feel sick or are concerned about exposure. Covid-19 Small Business Loans (PPP and EIDL) NFIB Research Center

The Paycheck Protection Program (PPP) and the Economic Injury Disaster Loan (EIDL) are the two primary loan programs available to negatively impacted small business owners in need of financial assistance. Currently, both programs are closed to new applicants. Many applicants who have submitted their application are still waiting to hear if their loan is far enough through the process to receive financing or if it has been suspended due to lack of program funds. Congress Agrees to $500 billion supplement to CARES Act

Congressional leaders agreed to a deal to replenish the Paycheck Protection Program. If the Senate approves the legislation, the Paycheck Protection Program Increase Act of 2020, the U.S. House of Representatives could pass the bill before the end of the week and have it ready for the President's signature.

Call to Action! Tell Congress: Replenish the Paycheck Protection Program

Two weeks ago, President Trump signed the CARES Act into law, providing $350 billion in emergency funding desperately needed by small businesses to keep their doors open and maintain their payrolls. Today, those funds have been completely exhausted. Small businesses will not be able to apply for loans from their banks under the paycheck protection program (PPP) until Congress passes supplemental legislation expected to provide an additional $250 billion. Congress needs to act NOW so there is no delay in getting access to much-needed liquidity to help small businesses weather this storm.

Executive Order 202.14 Continuing Temporary Suspension and Modification of Laws

The Governor today signed an Executive Order allowing the state to redistribute ventilators and personal protective equipment to hospitals with the highest need. The Executive Order also extends all NYS on Pause functions for an additional two weeks until April 29th and allows medical students that are slated to graduate to begin practicing immediately to help with the state's surge health care force.

Workers’ Compensation Insurance

Coronavirus (COVID-19) - Would workers’ compensation insurance cover exposure claims for NYSPHCC employees?
No, not at this time.
Specifically, for COVID-19, the nature of the work will determine whether not a claim with be compensable via workers’ compensation insurance. Nurses, for example, work with sick people as part of their normal job duties. If the nurse were to contract COVID-19 as a result of working with someone sick from COVID-19 then they could file for workers’ compensation.

CARES Act

The Coronavirus Aid, Relief, and Economic Security Act (CARES Act) was signed into law by President Trump on March 27, 2020. A provision of the CARES Act allocates approximately $350 billion to help small business in this time of worldwide health and economic crisis.  This initiative, known as the Paycheck Protection Program, provides 100% federally guaranteed loans to small business via SBA loans. Businesses in need are highly encouraged to take advantage of this program to help in this time of business disruption.

COVID-19 Update: New legislation to assist New Yorkers

The following is an update from the NYS Department of Labor regarding the COVID-19 Paid Sick Leave with guidance materials and guidance for employers:

Dear Employers and Business Owners:

Governor Cuomo has signed legislation to provide immediate assistance to New Yorkers affected by COVID-19. This will assist New Yorkers who have been subject to a mandatory or precautionary quarantine order and minimize the hardship they are experiencing through no fault of their own.

Under the new law, workers are guaranteed job protection and financial compensation while they, or their minor dependent child, are under an order of mandatory or precautionary quarantine or isolation due to COVID-19. The provisions of the quarantine legislation take effect immediately.

FFCRA will help the United States combat and defeat COVID-19 by giving all American businesses with fewer than 500 employees funds to provide employees with paid leave, either for the employee’s own health needs or to care for family members.
