Notice Regarding Potential Rights of Plumbers in Viega Pro-Press Copper Fittings Class Action Lawsuit and Deadlines Regarding Same

The PHCCLI has just received notices regarding a class action lawsuit involving Viega Pro-Press Copper Fittings.The lawsuit involved claims that Viega, a manufacturer of ProPress Copper Fittings, required that distributors of its fittings not sell fittings of competitors, and also charged higher prices to distributors that did sell fittings manufactured by competitors.It was alleged that the end result of these anti-competitive actions was that plumbers who ordered such fittings from distributors were forced to pay inflated prices for the fittings.A class action lawsuit was brought, and that lawsuit has now potentially been settled without any admission of fault by Viega.


It is possible that PHCCLI members or other plumbers could file claims in the case.Copies of the Notice to Claimants, a Claim Form, and a letter from the claimants’ attorneys are attached.

You should read them carefully and completely, but please note the following:


The deadline to file a claim via mail or e-mail is December 15, 2020.

In order to file a claim, you must have purchased Viega ProPress Copper Fittings from a distributor in the United States between January 29, 2015 and September 20, 2020.The value of your claim for past purchases will be determined by the amount you purchased, but they could be up to 25% of the cost of your purchases, excluding taxes, fees and surcharges.You can also receive a rebate on future purchases up to a cap of $500.00 upon submission of a separate rebate form that will be sent if you submit the existing claim form.You must provide proof of your purchases in order to recover.If you purchased only a small amount of fittings from a wholesaler, it may not be worth your while to submit a claim.


Note that you must be sure you’re a member of the class.You are not a member if you purchased the ProPress copper fittings directly from Viega, or if you only purchased other items from Viega, or if you’re an employee of Viega, or if you purchased the copper fittings outside the January 29, 2015 to September 20, 2020 time frame.


The deadline to opt out of the class is November 30, 2020. The only reason to opt out would be a seemingly unlikely scenario where you had a very large claim or special claims for damages and wanted to sue individually using your own attorney and filing your own lawsuit.The claim and potential damage recovery would have to be large enough to make this worthwhile.


If you do nothing, your claims will be waived and you will not be able to bring them in the future.


Assuming you don’t opt out of the settlement, you can also object to certain aspects of the settlement (but not the amount) if you submit an objection by November 30, 2020.
